These conditions will be governed by Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights (hereinafter, the "LOPD"), Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, which repeals Directive 95/46/EC (hereinafter, the "Regulation") and any other provision on data protection of the Union or the Member States.
Regarding the customer
IDenge, as responsible for the processing of the Customer's data, will apply, both at the time of determining the means of treatment and at the time of the treatment itself - and taking into account the state of the art, the cost of application and the nature, scope, context and purposes of the treatment, as well as the risks of varying probability and severity that the treatment entails for the rights and freedoms of natural persons -, the appropriate technical and organizational measures, such as pseudonymization, designed to effectively apply the principles of data protection, such as data minimization, and integrate the necessary guarantees in the treatment, in order to comply with the requirements of the LOPD and the Regulations and protect the rights of the interested parties. Likewise, Idenge will apply the appropriate technical and organizational measures with a view to ensuring that, by default, only the personal data that are necessary for each of the specific purposes of the treatment are processed. This obligation will apply to the amount of personal data collected, the extent of its processing, its retention period and its accessibility. Such measures will ensure in particular that, by default, personal data are not accessible, without the intervention of the person, to an indeterminate number of natural persons.
Regarding the user
IDenge does not use the personal data of the Users for any of the following purposes: (a) the exercise of its functions under these Conditions; (b) the provision of information to the user electronically about marketing opportunities related to the services and products of Idenge; (c) the fulfillment of legal, financial, accounting and administrative functions; and (d) the protection of the legal and contractual rights of Idenge. The processing of the personal data of the Users for the purposes indicated above and any others are processed by the Customers of Idenge. In this sense, the Customer will be responsible for maintaining the confidentiality of the data and information provided and for restricting access to his computer and his access codes to avoid possible unauthorized uses. In the event that the User has reason to believe that his data has been brought to the attention of a third party, or if these have been used in an unauthorized way, or are likely to be, he must communicate this situation to the Customer immediately. For more information about the processing of his data, consult with the Customer's Privacy Policy. Also, the Customer, at as responsible for the personal data of the Users, states that it complies with all the provisions of the LOPD and the Regulations, stating that it will be the sole responsibility of the same access, use and treatment, among other actions, of the personal data of the Users.
